She may cut her losses and take a short stint in jail or continue to fight what may be a losing battle. Either way, Lindsay Lohan will appear in court this week.

The starlet is heading back to L.A. today with her brother Michael Jr., in what some sources say is a sign she is leaning towards accepting a plea deal after all.

Lindsay stands charged with felony grand theft, having allegedly pilfered a $2,500 necklace. She faces up to a year in STATE prison if she's convicted.

She says she's innocent, but it's more complicated than that.

Not only would myriad probation violations likely land her in hot water even if she were found not guilty, the prosecution will dredge up Lindsay's klepto nature.

If she doesn’t take the deal, which would require her to spend three months in jail (whittled down to much less with good behavior) her past will be an issue.

That's because with probation, a judge alone makes the call. She could be remanded into custody as she awaits trial, ensuring she's locked up either way.

In any case, she has until March 25 to take the plea deal on the table. If she passes, which she has to this point, a preliminary hearing will take place in April.

Lindsay Lohan will be charged with a single count of felony grand theft in an L.A. court Wednesday, stemming from her recent necklace caper.

She will be arraigned at 1:30 p.m., in person.

Lindsay will be charged with stealing a $2,500 necklace from an L.A. jewelry store. If convicted, she could be sent to California State prison.

Lohan will not be handcuffed and paraded in front of cameras prior to arraignment, but will simply surrender to the court when she shows up tomorrow.

After Lindsay is arraigned, she will be taken to the basement of the courthouse where she will officially add to our gallery of celebrity mug shots. Awesome.

Presumably, she will be granted bail by the judge and post it on the spot. We've been over this enough times with Lohan that we're pretty confident by now.

Yes, another one! Who could forget the stirring melodies and heart-wrenching lyrics of A Father's Love!

Anyway, Michael Lohan has reportedly commissioned another song to be written in his daughter's honor. This time, the Lindsay Lohan-centric jam was written by Delious Kennedy, one of the members of the Grammy winning group All-4-One.

Michael is calling the song a sort of response to Lindsay's 2005 track Confessions of a Broken Heart (Daughter to Father), adding that it's about a "talented and beautiful young lady who has grown in our hearts, she is badgered by paparazzi, cut down by the media … She will wilt, but when she falls, I will always be there to pick her up and put her pedals back on."

Deep. Sounds like its going to be one hell of a ballad.

Oh, wait…it's not.

Actually, Delious says the song, entitled My Rose, is a club track with a sick dance vibe. He admits that he laid down the track last week and that Michael "loved it."

From what we're hearing so far about it, what's not to love about it?
